The Ohio Revised Code recognizes several types of assault. There are two types of “simple” assault: (1) knowingly causing or attempting to cause physical harm to another or to another’s unborn, and (2) recklessly causing serious physical harm to another or to another’s unborn. There are three types of felonious assault: (1) causing serious physical harm to another or to another’s unborn, (2) causing or attempting to cause physical harm to another or to another’s unborn by means of a deadly weapon or dangerous ordnance, and (3) having sexual conduct as an AIDS virus carrier. There is also aggravated assault, which occurs if a person knowingly commits felonious assault when under the influence of sudden passion or in a sudden fit of rage brought on by a serious provocation by the victim. And, there are special offenses of vehicular and aggravated vehicular assault which arise out of circumstances involving accidents caused by reckless driving or driving under the influence of drugs or alcohol.
